ModCorr and the March 2025 modular-buildings registry event: DOAS's answers and its 2007 agreement with GSFIC

Georgia Department of Administrative Services · Request 2027-OPN-00071 · Filed September 2, 2026 · Fulfilled

GPS asked the Department of Administrative Services (DOAS) for its records on Georgia Procurement Registry event 46700-GDC0001150, "Modular Correctional Buildings," and on any award to ModCorr LLC. DOAS gave the event's audit history (posted March 4, 2025, end date moved from March 11 to March 12, marked reviewed March 13) and said it holds no records of a sole-source award or waiver, of an award notice naming ModCorr or MaxMod, or of a statewide or piggyback contract for modular correctional buildings. It released state supplier-system screens showing ModCorr LLC's bidder profile was created March 5, 2025, and the December 2007 Intergovernmental Services Agreement under which GSFIC procures construction projects whose contracts it signs "as prescribed by prevailing GSFIC requirements for such procurements."

Status: DOAS closed the request on September 16, 2026, writing that its email "constitutes the entire response." It had no records for items 2 and 4, or for item 3 as to ModCorr and MaxMod. It pointed GPS to the Georgia Procurement Registry for the event's attachments, to the Department of Corrections for the responses to the request for information, and to the Department of Public Health for its contract with SLSCO Ltd. (Agreement # 40500-019-25255228).

What we asked for

To the Open Records Custodian:This is a request under the Georgia Open Records Act, O.C.G.A. § 50-18-70 et seq., from The GDC Accountability Project, Inc. (Georgia Prisoners' Speak), a Georgia nonprofit newsroom. Background, so you can see what we're actually after. On April 25, 2025 the Georgia State Financing and Investment Commission executed five Design-Build-Install agreements with ModCorr LLC for modular correctional buildings: GDC-171A at Hays State Prison, GDC-171B at Lee State Prison, GDC-171C at Montgomery State Prison and GDC-171D at Dodge State Prison, at $20,173,811 each, and GDC-172, a medically intensive infirmary at Johnson State Prison, at $4,890,000. GSFIC produced those contracts to us on September 2, 2026 and told us in writing that it did not conduct the procurement behind Georgia Procurement Registry event 46700-GDC0001150 and holds no records of that procurement. That event is a request for information, opened March 4, 2025 and closed March 12, 2025, and we can find no award record for it. We're asking your office because the State Purchasing Division administers the Georgia Procurement Registry and the state's competitive-bidding framework. We request the following records, for January 1, 2025 to the present unless otherwise stated:1. The complete system record for Georgia Procurement Registry event 46700-GDC0001150, Modular Correctional Buildings, including any documents attached to the event, the event history or audit log, and any responses received.2. Any request submitted to DOAS, and any DOAS approval, denial or determination, concerning a sole-source award, emergency procurement, waiver, exemption or exception from competitive bidding for modular correctional buildings or for ModCorr LLC.3. Any notice of intent to award, award notice, or award posting naming ModCorr LLC, MaxMod, or SLSCO Ltd.4. Any statewide contract, cooperative agreement, or piggyback contract under which modular correctional buildings could be purchased, and any record showing whether the ModCorr purchases named above were made under one.5. Vendor registration records for ModCorr LLC in Team Georgia Marketplace or the state supplier system, sufficient to show the registration date and status.6. Any policy, memorandum of understanding, delegation agreement or written determination between DOAS and the Georgia State Financing and Investment Commission concerning which agency's procurement rules govern construction or design-build contracts of this kind. For any item where DOAS holds no responsive records, we'd be grateful for a short statement to that effect rather than silence, and a pointer to the agency you believe does hold them. That is as useful to us as the records. We note your published rate of $26.93 per hour with no charge for the first quarter hour. We agree to fees up to $50.00 and ask to be notified before that amount is exceeded, with the itemization by position, hours and rate described in O.C.G.A. § 50-18-71(d). Electronic delivery to accountability@gps.press is preferred. We are sending this by email because your Records Management page publishes this address and states that requests may be made in writing. If your office would rather we file through the Records Management Portal, please tell us and we'll re-file there the same day. We would rather not have the same request sitting in two queues. Records requested under the Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq.), by Georgia Prisoners' Speak or, where a page says so, by another person or group who shared them with GPS. Documents marked "as released" are posted exactly as the agency released them. Files marked "prepared by GPS" are GPS's own compilations of those documents, made for convenience; where they differ, the released document governs. A request is published here when GPS cites it or when its records are useful to readers; records about individual deaths are published on GPS's mortality pages, not here.
