ModCorr modular prison buildings: GSFIC's five contracts, payments to July 2026, and how ModCorr was selected

Georgia State Financing and Investment Commission · Request GSFIC-20260828 · Filed August 28, 2026 · Fulfilled

GPS asked the Georgia State Financing and Investment Commission (GSFIC) for its records on modular correctional buildings supplied by ModCorr LLC to Georgia Department of Corrections prisons. GSFIC released its five Design-Build-Install agreements with ModCorr: GDC-171A to 171D, dated April 25, 2025, each $20,173,811 for two 63-bed MaxMod housing units at Hays, Lee, Montgomery and Dodge State Prisons, and GDC-172, dated June 4, 2025, $4,890,000 for a medically intensive infirmary at Johnson State Prison. Its payments spreadsheet lists 42 paid ModCorr invoices totaling $89,762,212.23, received from June 27, 2025 to July 28, 2026; the five contracts total $85,585,244. GSFIC said it did not conduct the procurement behind Georgia Procurement Registry event 46700-GDC0001150, and its procurement summary says GSFIC reviewed the two responses to the Department of Corrections' request for information, from Aries and ModCorr, and recommended a direct purchase from ModCorr.

Status: GSFIC released the contracts and the budget act on September 2, 2026, the payments spreadsheet on September 11 and the procurement summary on September 17. For item 3 it said it holds no records of the registry event because it did not run that procurement. GPS later asked for change orders to the five agreements, then declined GSFIC's $100 estimate for them and closed the request on September 22, 2026.

What we asked for

To the Open Records Officer:This is a request under the Georgia Open Records Act, O.C.G.A. § 50-18-70 et seq. We're seeking records held by GSFIC concerning modular correctional buildings supplied by ModCorr LLC and installed at Georgia Department of Corrections facilities. Our understanding is that MaxMod modular housing units were placed at Dodge, Lee, Montgomery and Hays State Prisons, and that a 20-bed medical intensive infirmary was placed at Johnson State Prison. We're asking GSFIC because these appear to be state capital projects and the records may sit with the Commission rather than with the using agency. We request the following, for the period January 1, 2022 to the present:1. Any contract, purchase order, award document, task order or amendment between GSFIC and ModCorr LLC, and any such document naming ModCorr LLC as a subcontractor or supplier, together with the total value of each.2. Any project file, budget authorization, funding resolution or capital-outlay record held by GSFIC for the installations named above, including any record identifying the funding source and the state entity responsible for payment.3. All records connected to Georgia Procurement Registry event 46700-GDC0001150, "Modular Correctional Buildings," a request for information opened March 4, 2025 and closed March 12, 2025, including any solicitation documents, responses received, evaluation records and award records.4. Records sufficient to show whether a competitive solicitation followed that request for information. If no competitive solicitation was conducted, any sole-source determination, emergency-procurement justification or equivalent written authorization relied on instead.5. Any disbursement, payment or invoice record showing amounts paid by GSFIC to ModCorr LLC, or to SLSCO Ltd. or Sullivan Land Services Co. in connection with these installations. If GSFIC holds no responsive records for any numbered item, please say so for that item specifically rather than for the request as a whole, and where you can, identify the agency you believe holds them. We'd prefer electronic production, in native or searchable PDF format, to this email address. We don't need paper copies and we're not asking for inspection in person. If you estimate the cost of responding will exceed $25.00, please provide an itemized estimate before any charges are incurred, as provided by O.C.G.A. § 50-18-71(d), and we'll narrow the request if that would reduce the cost. If any portion is withheld, please cite the specific exemption relied on for each withheld record, as required by O.C.G.A. § 50-18-72(h).We understand the Act requires a response within three business days, under O.C.G.A. § 50-18-71(b)(1)(A). If the records exist but can't be produced in that time, we'd appreciate the written timetable that provision allows.Thank you for your time. The GDC Accountability Project, Inc. What happened

August 28, 2026Request filed by email to GSFIC.
September 2, 2026GSFIC released the five executed ModCorr agreements and the Amended FY2025 budget act (HB 67), saying projects GDC-171A to 171D were funded by HB 67, Item 968, and GDC-172 by the FY2026 budget (HB 68, line item 380.46). It said it did not conduct the registry procurement and estimated $105 to retrieve the remaining documents.
September 2, 2026GPS approved the $105 estimate.
September 11, 2026GSFIC sent a spreadsheet of all payments to ModCorr and offered the individual payment applications for the $105. GPS took the spreadsheet in their place, so no fee was incurred.
September 13, 2026GPS asked for any change orders or amendments to the five agreements.
September 16, 2026GPS asked for GSFIC's records showing how ModCorr was selected for the five projects.
September 17, 2026GSFIC released a two-page procurement summary, "Note for Selection of Modular Units."
September 22, 2026GSFIC estimated $100 to retrieve the change-order records. GPS declined the same day and closed the request.

Cost

$0.00: No fee charged. GSFIC estimated $105 to pull the individual payment applications; GPS took the free payments spreadsheet instead. A later $100 estimate for change-order records was declined.

Records requested under the Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq.), by Georgia Prisoners' Speak or, where a page says so, by another person or group who shared them with GPS. Documents marked "as released" are posted exactly as the agency released them. Files marked "prepared by GPS" are GPS's own compilations of those documents, made for convenience; where they differ, the released document governs. A request is published here when GPS cites it or when its records are useful to readers; records about individual deaths are published on GPS's mortality pages, not here.
